Beginning December 7, 2011, in addition to their providing
to all newly hired employees at the time of hiring a copy of the
MW-400 form that is available at the following link: http://lwd.dol.state.nj.us/labor/forms_pdfs/EmployerPosterPacket/MW-400.pdf
New Jersey employers are also required to post the
MW-400 form in conspicuous places in the workplace, which generally
will be the location where other required employee notices are posted.
For companies that maintain an internet website, the "conspicuous
posting" requirement can be satisfied by posting the notice on the
company's website, provided it is accessible to all employees.
With the requirement of employers providing newly
hired NJ employees with copies of MW-400, employers providing the
notice would be well advised to keep a record showing that the notice
has, in fact, been provided.
